hello guys.
i live in south florida and going to file soon.
i am married but going to by myself .
the mortgage is in my wifes name but i am on the title.
we have about $80000 in equity
is the house protected by the homestead exemption?
can they take it?
also doesn't every item inside the house belong to both of us
if so the trustee can't take it right?
i heard that in florida u have to provide pictures of the outside of the house and of every room .is that true?

If you live in the house, and intend to continue remaining in the house, then it is exempt.

As for everything in the house, you can generally exempt all of it as property held in tenancy by the entirety so long as you and your wife have no joint creditors and she is not filing.

Trustees sometimes request photographs of all your property listed on Sch. A and B, and sometimes demand home inspections. It is typically decided on a case-by-case basis.
