    Hoping my paralegal is correct.

    Hi! Newbie here!
    I am currently in the process of filing a ch.7 in Florida that will include my house. I got a letter in the mail yesterday from Florida Default Law Group saying that GMAC is attempting to collect the full amount due on the house and I have 30 days to respond and the law group is in the process of filing a claim for foreclosure.
    So I call my attorneys paralegal and she says not to worry about it and that we do not need to notify them of the bankruptcy that everything will be taken care of, it will be discharged in the bankruptcy.

    Has anyone gone through this and is this what you were told to do?

    If you've not filed, you darn sure need to include your lender in the creditors matrix.
    Once you file, the automatic stay kicks in and foreclosure is halted until the bk is discharged and closed unless, they ask for relief from stay.

      We have given our paperwork to the attorney but the attorney has not filed with the court yet.
      I have been reading on this forum for the past hour...maybe longer. Some people are saying that even if we surrender our house that the foreclosure will still show on our credit report. My paralegal said that the foreclosure will go through but it won't be in our name. So if the foreclosure won't be in our name, how/why will it get on our report?
