Any general consensus as to which creditors usually file claims in asset case?

    Any general consensus as to which creditors usually file claims in asset case?

    I haven't paid on my cards in over a year. For the most part I hope to be a no asset case, depending on how the trustee decides to value my house and of course whether or not I will be getting a tax refund and he decides he wants part of it...

    But, if he does decide he wants to make me an asset case, from what I understand he will inform the creditors that they have XX number of days to file a claim, right? How long does he usually give them?

    Will the fact that most of my accounts have charged off and some are with collection agencies make a difference as to whether or not claims are filed?

    Are there certain creditors who are known for always filing a claim no matter what the amount is (and vice versa - are there ones who tend to never file a claim)?

    lalap123 - the only difference that occurs if a claim is filed is that the asset is used to pay the creditor. If no claims are filed, the trustee abandons the asset and you get to keep it.

      You can rest assured that most will. For me just about anything to do with unsecured debt did.

        Pretty much all my creditors filed a claim. My student loans got the lion's share of my payout after the trustee took his double dip.
