We had a breach of contract lawsuit filed against us in our local superior court last May. We filed bankruptcy in June before a trial date was set and the case was put on hold. Our discharge came in Sept. and the court has a copy of the discharge on file. But the case still shows as open. I called the court and was told there is nothing that I can do get the case closed and that it's up to the filing party to revoke the case.
I was looking at an application for a secured loan the other day and one of the lines was "Do you have any pending lawsuits", which I assume I would have to answer yes to. Has anyone been through something similar? Is there anything we can do to get this closed? I've pretty much severed ties with my attorney and would rather not have to get involved with him again.
Ideas?
