      Thanks. I'm not sure if there was anything else I could've said or done... we were asset heavy and fortunately didnt lose anything except the cash on hand and part of Trustee's fee.
      BKFiler, first congrats on your case!!!!!
      Yes, they did just tell us something... no one, nothing is impartial in the case. I hope our experiences will give some insight for other filers, especially those facing hearings. By the way, reaffirmations were nothing. My second mtg company (who messed up the paperwork 3 times - wrong case no., wrong state) said that they never get reaffirmed, just a formality for them to try. This Judge reaffirmed the account, go figure. Par for the course in our case.

        Nc7Pro, So glad for you to have this part over with and that you are not unhappy with the outcome. I think your experience will help others who run into difficulties like yours. So glad you shared with us and now it sounds like it is about time for your case to close. Is that correct??

          now what are you saying? that the judge allowed a mortage reaffirmation on your dime and you didnt want it?

            Sorry to take so long to reply... got moved to another shift at work and still trying to get used to it!

            What I was saying in reference to the reaff is that the creditor did not expect the Judge would allow it. Talked with them many times due to the errors in the paperwork. We wanted to reaffirm the account as did they but they told us not to expect it. They cut off our line of credit until if/when reaff'd. I guess my point was to "expect the unexpected."

            We have yet to reaffirm the first mortgage, they sent their paperwork in late... hearing on 2-16. Will post an update.

            Thanks to all who helped us along the way. Just reading your posts helped maintain my sanity!

                    You came out smelling like a rose considering all the assets you had...... yes, you were asset heavy.

                    The Trustee cut you a deal at the end but also made sure he got himself paid for his troubles....... He really helped you keep a lot of your assets (and that unusual for a Trustee)....

                    The Court would have ruled with the Trustee (due to the facts - YEAH SURE) and you would have paid out more.............

                    So glad to hear you kept a cool head on your shoulders thru all this and you did GREAT as a pro se filer - but I wouldn't recommend it to most people.... Especially under the new laws.

                    Use your "fresh start" wisely - make it work for you!!!

                      Yep I just filed. I am filing in Greensboro. I have a hearing next week because I asked the court to accept my petition before I got the credit counseling. I just got the counceling certificate so this should not be a problem I guess. I have my 341 on 2/27.

                      I wil be glad when this is over. This whole thing has been pretty stressful.

                        Thanks Minny. This time, we will do things right... will disregard the offers in the mail and stay on track using cash only. This was very stressful for us but I read your case and it brought tears to my eyes... You are a very strong person and I wish all the best for you.

                        Stewie, let us know about your 341. Good luck and get those NC exemptions right (Federals not allowed in NC)... Trustees dont like those amendments!

                        FYI, I applied (online) to Wachovia for a checking account. A message popped up saying they would contact me by email. The email said they would call but after 2 days, nothing. So I called them. They were very nice. Approved during the call, no problem! They pulled my credit report but never mentioned our BK. For those needing free checking with a BK on record, good place to check in to!

                          I think my exemptions are fine. I think with my equity in house, car, and person stuff I used like 2500. with the wildcard I think I could take like 3500 so I should be ok as far as I know unless the trustee does not agree with the value of my stuff.

                            Sounds good. Our Trustee went with the values we listed (although they may look them up if in doubt). Sounds like you're on the right track and I look forward to hearing more from you!

                              Well I had my hearing on exigent circumstances, I had to explain to the judge that I had obtained the counseling. It was pretty intimidating! not like traffic court at all. I was the only person in court who was not a lawyer!

                              Anyway I just stood up and explained to the judge that I had received the counseling and he was fine with it.

                              Just waiting for the 341 now...

                                Luck Pro Se

                                Wow, after reading this post, I feel pretty darn lucky the way my situation played out. I filed in October and when I attended my 341 in November I was the ONLY person in the room without a lawyer. It made a very big impression on me as I sat and waited. However, Trustee had NOT ONE question for me, and read his list of questions while looking out the window. It was over in 3 minutes. I truly was "bankrupt" in every sense of the word, no nothing and renting. The only precaution I took was to hire someone to do my paperwork, a paralegal who knew what would be red flags. Maybe my situation was so bleak it wouldn't have mattered. I just hope for you everything went okay. Let us know what happened!
