How long do I need to wait to file Chapter 7 again?

Hi! I had filed BK Chapter 7 back in 5/2002. I was wondering how long before I can file again? I heard that you need to wait 8 yrs before you can file again, but since I filed before the new 8 year law does that new law apply to me even though I filed it back in 2002? If so, then that means I can't file till May of this year am I correct? I am currently being sued by one of my creditors and I need to appear in court on Feb. 4th. I am currently unemployed and a single mother of 4. What do I do when I go to court since I probably won't be able to file for BK till May. Do I just tell them that...cause I have no money to pay the creditor. Thank you!

It's 8 years from your last filing date. That applies to everyone regardless of when you last filed bk.

you can file again in may 4 months away get in touch with attorney now and advise judge advise creditter of this chapter 7 in 4 monthes if it goes to court you advise judge of pending bk on your part this will hold them off you are so close now i doubt they will waste time trying to sue you
