Former husband contends (despite many hearings) that he is owed from our divorce agreement/property settlement agreement.
He was listed as a creditor when I filed Chapter 7. I am discharged and closed.
He had retained a bankruptcy attorney who filed an AP and they alleged fraud on my part and that is why he didn't want the property settlement included in my BK. His fraud allegation was not financial, he alleged I had an affair (didn't) and that was why I should have to pay him. Did I mention he is nuts? Anyway. Judge tells his BK attorney he is walking a very fine line and will be sanctioned if he proceeds with filing. His attorney withdrew the motion (he actually had the best bk attorney around here), and my case proceeded with discharge and closing.
We had no joint debt in our divorce agreement and the one thing we did have, I reaffirmed. He states I owe him $$ from the sale of a property. (but has already been denied in family court) and he also alleges my "debt" to him was not wiped out with the bankruptcy. He was listed as a creditor with potential liability and it was marked disputed.
I have read many different opinions on how only a 13 can wipe out this debt but have also been told by several bankruptcy attorneys, that isn't true, that it was in fact wiped out (the potential liability).
Won't hold anyone to it, but was looking for your opinions.
