    Does Hardship Program put Ch. 7 at Risk?

    Since my biggest concern is a creditor freezing funds before I can file, what about joining their hardship programs, making monthly payments, then filing for Ch, 7 once I know I am in a good position to do so?

    Advantages: The calls would stop, the risk of having my accounts frozen would stop, and I could file when I am good and ready, not because I am 'forced' to (in response to a summons).

    With my current monthly expenses, there's not room to pay them much, but as time passes, they are all willing to drop their 'ask' dramatically, so it's possible we could agree on something I could live with (until I file).

    Will this work? Or could this be brought up as my having not negotiated in good faith or something similar (I have no idea).

    Not a problem, you can enter into a creditors hardship program without jeopardizing your BK.

      Ok, then. It could well be worth it to join their programs just to buy time to deal with the future (while the universe simmers). Thank you.

        Part of me understands why you would go on board with a hardship program (to make the nonsense stop) but why throw any money at them if you are going to file?

          Primarily because I have been spending a LOT of time trying to figure out how to protect my assets (bank accounts, property) in the event I get sued. it dawned on me that it would be easier to join the creditors' hardship programs to put an end to the worry.

          I finally got it through my head tonight (after reading another thread in this forum) that that I am not going to get sued. It's just too early in the process based on what others are posting about timelines. My first missed payments were in November and I hope to be ready to file in February.

          So, no, I probably won't need to join the hardship programs. I've also routed all calls to another phone number that a) does not ring and b) I don't answer. That's working out a lot better. It took me awhile to realize I do not 'have' to talk to them.
