WOO HOO!!!! Thank you ALL :)

So we had our first meeting today with the paralegal and things look FANTASTIC!!! And.. thanks to all the knowledge I've gained through all your advice and help... she all but offered me a job!!! She seriously couldn't believe how much I knew and said that they just hired two new girls and I understand and know more than either of them, but as soon as they were hiring again, she was going to put in a word with the attorney to see about getting me on part-time! HAHA! Anyway... I thought that was pretty cool

So the meeting went EXTREMELY well and you all were right - I am way to worried for no good reason. We are going to wait until the end of June to file so that I can file along with my husband.

She said she sees no reason why she can't get us through a 7 with flying colors, but if something unexpected comes up and there is even ANY question as to whether it will fly, we'll do ch13.

I learned a few things today that I was surprised about in NC.
    1) When filing jointly, you CAN double the $5000 wild card from leftover homestead exemption (does that make sense? not sure I am wording it correctly). I remember trying to find that info out and couldn't find anything saying that you could indeed double that exemption.
    2) A credit card transfer to a checking account is not the same thing as a cash advance and does not look as bad.

I think the $5000 thing was what surprised me the most. There was more, but my brain is stuck on cars right now.

Oh... she also said that it's now mandatory (or as of Jan 1 - can't remember) that ch 13 payments be taken directly from the paycheck and mortgages must be paid inside the plan.. not outside.

So, thank you all again!! Now I just have to wait 7 months! That's a LONG time for nasty creditors to be calling and harassing us. I hope my husband can handle it. Thank goodness for caller ID and answering machines.

Wow, is that a federal law update I wonder. That would mean all employers know about 13B? What happens if you pay from other sources such as tax refunds. And mortgages inside the plan? Wow, that's a lot of extra money that might throw some people right out of 13.

Yeah... I dunno anything else about it... but definitely sounds like it could mess a lot of people up. Maybe it only pertains to people who file in the future... rather than those who already have a plan in place.

Good to hear you finally got in to see an attorney.

Do you think this is the attorney you will retain? You could probably just deal with the calls for about two months and then retain your attorney. After retaining your attorney you could start to give their information to creditors. That would stop most or all of the calls while waiting to file in June.

I definitely think we will go with this one.

We found a couple cars, but didnt drive any yet. We re going back out today. It is so hard to take on a second car payment when we havent had one in so long.

I know what you mean. We didn't want to take on the car payment, but we knew it was a new car for 5 years or pay the CH13 trustee that amount for 5 years. Easy decision for us.
