    I Hope someone has an answer for me

    Hi everyone,
    I filed in sept 2008, was discharged in April 2009. Now my file never closed because the UST was investigating a creditor that repo'd an item when I had
    automatic stay. Anyways, we were told that were were discharged and that it didn't matter that we didn't close. So today I get in the mail a letter from the courts, saying Notice of proposed abandonment.

    XXXX, trustee for the above captioned case, has filed a notice of intent to abandon certain property described below as being of inconsequential value to the estate. If any creditor or other party in interest has an objection to the proposal abandonment, the objection and a request for a hearing on such objection shall be in writing, serves upon the Trustee and filed with the Clerk of United State Bankruptcy Court, such objection and request shall be filed with the Clerk and serves upon the Trustee no later then Nov 30, 2009. In the event an objection is timely filed, a hearing will be held before the honorable XXXXX on such and such date.
    If no objection is filed with the Clerk and serves upon the trustee on or before Nov. 30, 2009, the abandonment will take effect on the fifth day followin g the last day to filed objection.

    Someone please explain what this means. We were discharged april 2009.

    That means the trustee thinks there is no recovery to be had from that creditor so they will close your case now.

      Yes, that is good news. Unless one of your creditors thinks that you have some non-exempt property and files an objection (unlikely after this much time), your case should be closed before too long.

      Often the trustee will keep a case open waiting for a tax return or to investigate some potentially juicy asset, but in this case it appears that the only reason they kept it open was related to the violation of the automatic stay.
