    Question about what to expect

    So I am going to my 341 this Thursday in Seattle. I filed in Western Washington. My question is should I expect to lose my tax return next year? Last year it was fairly low and I have no assets at all.
    The reason I ask is from reading how it is common sometimes?

    You should be fine. I was a no asset case in IL. with an average tax return of $1600 the last few years and the trustee had no interest in it. What are they going to do split it among my creditors that I owed $56K to and give them each a couple of hundred bucks? Its not worth it to any of them. Wait until you leave that 341. You will think what in the #$%^! was I worried about. Life gets better, hang in there!

        the 341 marks the 60 days because it is last of the many days that have been dark clouds over us. Some longer then others some for different reason but none the less it brought us to the same point.

        That is what I think the 60days means. Being able to see the light at the end of the tunnel, and BTW it's GREEN!

          The chances of having a creditor or your trustee file objections to your discharge in Ch 7 is very, very small....about the same as a meteor hitting your house today

          I have over 100K in cc debt so I am quite nervous and one of them is a credit union – not local.
          The amount of your debt doesn't matter - it's when your income is well above your state's median income for family size and you try to file Ch 7 high that gets more scrutiny from the US trustee. Doesn't sound like that's an issue for you.

          As far as the credit union goes, unless you have cross-collateralized loans (like a car loan and a CU-sponsored credit card both active at the CU), there's nothing to worry about here either. Just watch for violations of your automatic stay if the CU tries to collect on one of your debts listed in your Ch 7.

          My lawyer filed just last Tuesday and my pacer states: meansno, and the letter I received from the court states “the presumption of abuse does not arise”…this forum has been very helpful in easing my concerns…I believe I’ve been reading it for hours a day.._J
          Since you've already seen "the presumption of abuse does not arise" on PACER, your trustee has already decided that you have no assets for him/her to pursue. Now it's just waiting out the 60 days (thus the "60-day club" ) until you are discharged and start your new financial life!

          Try not to worry. You are on the home stretch. Hang in there! 60 days will pass before you know it, and then you'll get your own line of celebrating dancing critters from AngelinaCat

            Hi Toomanycards, I live in the Rockford area so thats where I filled. You cant get much better answers for your questions than lrprn posted. Thats beauty of this forum. It will go well, good luck!
