Would it be best to have a negative DMI, be under the means test and have secured debt close to or higher than the limit so as to be reasonably assured you are a CH 7 and not a CH13, and if that is not the case has anyone ever been put into a 13 when the above 3 conditions existed?

Remember that your looking at actual expected expenses on the schedule J. That said, a negative is not nessesarily bad, but you don't want to have some huge crazy negative number that would draw attention.

Its just that my income is way less than it used to be or even will be after I file although it will go up after I file I hope. My expenses from being an independent contractor are rather high. I have to purchase my own health insurance, life insurance, liability insurance for work as well as license fees etc and unless they tell me I can't keep these items, it makes my sch J numbers quite negative. Now it may be that once I file I may not be able to afford to insure myself or family unless my income increases. Time will tell.
