So, we dropped our paperwork off at our attorneys 2 weeks ago, got a call from her assistant today. She wanted to know the following: Are both of our names on my cars title? Yes. Are both of our names on my husbands truck? No. Just my husbands. What is my grandmas address and name? We borrowed money from her 6 months ago and paid her back. I asked that she please note in our petition that if they want that money back to repay our debtors, please come after us, not her as she does not have the money. Neither do we of course, but I would rather take care of it than have her get involved. I am just wondering when we would be able to check pacer? I don't know what all the days mean. 60 day club etc...Our attorney said that she wants everything filed by the 15th at the latest. Does anyone know how likely the trustee will be to go after the $1200 we borrowed and repaid our grandma?

you cant check pacer till you actually file, nothing to check up till that point. as far as the $1200, if they want it, they will go after her, but they would have to see that loan payback as a preferential payment. your lawyer might just be covering all the bases just in case tt questions that. you going for a 7 or 13? others can answer that $1200 better im sure. -
We are doing a CH 7. It wasn't a preferential payment. I had made a double payment on our house by mistake and she had to borrow money from I believe and IRA to help us. I hadn't been late on any payments or anything like that, and just paid her back when I took a hardship withdrawal on my husbands 401K.Comment

part of the issue will be whether you paid her back more than you paid other creditors during that period. but also, $1200 is not that much money and may be more trouble than it's worth to the trustee. it will depend on the trustee but there is a good chance they won't go after it. keep your fingers crossed.
