    Chrysler Financial is puzzling me

    Hi. Long time lurker here. Lots of valuable information I have used through my whole bk process. I am in Day 79 of waiting discharge in a no asset Chapter 7 case in Northern Mississippi and am on Pacer shown as "Awaiting Discharge".

    I wanted to see if anyone has experience with Chrysler Financial and if what is happening to me with them happens to other folks. I am in year 4 of a 6 year vehicle finance with them. In that time I have NEVER missed a payment or even been late ever. I decided to reaffirm my Jeep with them and my attorney sent them an intent to reaffirm. In reviewing Pacer a couple of months ago, I saw that CF had hired a local Memphis attorney who was requesting to be kept current on the loan.

    On July 7th (in fact, it was immediately after my 341 hearing, literally in the hallway outside afterwards) I signed the reaffirmation papers they sent and my attorney sent them out that afternoon. (of which I do believe he sent them out, I signed 3 that day and the other 2 got there). Well, I have been wondering why the CF reaff has not been showing up on Pacer and last Friday I got my answer - CF served me with papers asking for a lift of stay and to abandon my Jeep to them since I signed an intent to reaffirm but have not. (even though it was mailed).

    During this whole process of bk, I have been making my voluntary payments each month, on time, and also calling CF and telling them they are coming each month. Can anyone tell me why Chrysler Financial would do this to me? (i.e. wanting me to give the car back and everything when I've never been late or missed a payment even through bk). I have been trying to call their attorneys office in Memphis to get new reaff paperwork sent since my attorney shows he sent off the original.

    What is other's experience with Chrysler Financial? Not trying to do a ride through or anything. Pretty chagrined that they're doing this to me, someone I think who is a good customer and not letting my bankruptcy affect them. What are my rights here? Now I am terrified I am going to discharge (like I said, I'm in Day 78 of awaiting discharge in a very busy district) before I can get this done. Any experience with CF would be much appreciated.     Part of your problem might be timing. Chrysler declared bankruptcy this summer as you know, and the old Chrysler financial ceased to exist as part of all of that. It would be very easy to imagine that paperwork is getting missplaced in the chaos. Chrysler emerged from Bankruptcy in mid-June.

      I would guess that CF is wanting to take back their vehicle because they somehow did NOT receive your reaffirmation paperwork. I have read on here that Chrysler does not allow ride-thru's (we had a CF lease but surrendered it back before we filed BK). It's very possible that either your attorney didn't send it, or it just somehow didn't make it to CF... I would call them (CF) tomorrow & ask them if they received them. If not, then I would be on the phone to my attorney letting them know this. Since you are not yet discharged there's still time to get those papers faxed to CF.

        Im curious about this situation because I might be in something like this.

        before they to reposses your car can you pay the loan amount off and get to keep it? Im in the same situation and wonder if there are issue reaffirming can you pay the loan off? Could I do this during the 60 days or wait until discharged? Will the trustee get mad?
