    Need Clarification - Card and Expense

    I met several attorneys and decided to retain one of them.

    But I still need to clarify the following. Any suggesion or similar experience?

    1. There was a Big Cash Advance in May to pay other bills


    Attorney 1 recommended me to stop paying CC. (I want to retain this att)
    Attorney 2 & 3 recommended me to pay 2-3 months more before filing BK.

    If I keep paying a specific credit card only, is this causing any problem later? preferential fraud, etc? What would be the best strategy? Stop paying everything or keep paying only the credit card...?


    2. Expenses
    I am on the edge of Chapter 7 and 13. If I replace car tires and have a dental service (yes, I and my daughter need them now), can this help me be qualified the Chapter 7?

    Can I use all these expenses in the means test or any schedules later?

    I don't want to create any bad-look file later. (big expeses before filing...)

    Any suggestion or advice would be highly appreciated.

    A "big" cash advance is not good. How big is big?

    Dental and Tires fine, those aren't luxuries although you may need to supply exactly what dentistry was performed...Full mouth hollywood crowns would be "frowned upon"...

    Chapter 7 is based upon your income from 6 months previous to some undetermined point in the future, usually another six months...and you may need to pay at least token amounts for several months on the cash advance, and be able to show what you did with the money.
