    Capital One Charge-off Clarification, Please!

    I have a Capital One Personal Loan that has a little over 6k balance. Cap 1 says they will charge off in a couple weeks - after only about 60 days past due. Good, I thought. Now they will stop spontaneously dialing me. Will that charge-off haunt me forever? I haven't filed yet, can't for another seven months. I had assumed that charge-off would be discharged in bk 7, but another thread suggests that this is not the case. What happens with it then? Is it the same or worse than a bk on a credit report?

    Not that I can do anything about it one way or the other. Broke is broke. Just curious.

    Same thing happened to me. When they charge off a debt, it is usually sold to a collection agency so be sure to include the original debt in your bk along with the new owner(s).
    Filed Ch7 5/28/09 (Pro Se) Orlando, 341 7/01, UST selected case for audit 7/01, Last day for objection 8/31. Audit report filed 9/10, no material misstatements. Discharged and closed 9/22/2009

      The debt will be discharged in a 7. The notation on your credit report will show "charge off" if it happens before you file.

      10-28-09 DISCHARGED/CLOSED!!!!

        Capital One charged off my debt and then filed a lawsuit against me and got a lien on my house. Of course now that is all being discharged in my BK but thats thier typical M.O. Capital One is not a company that just lets it go... I only owen them 1700.00. I owed bank of america 8500.00 and they never bothered!

          That is weird in comparision we shouldn't be making preferred payments to creditors and yet some come with a venegenace and others, they just don't bother. For me personally, I am watching out for BoA becaue out of all the credit accounts I have filed for BK, BoA is a pain in the $%&*(. They even filed a civil summons almost 3 weeks after I filed for BK. I do not know if they stopped it or did not do anything so I am watching (Attorney barked at their attorney however).
          Chapter 13 filer since Feb. 2018 under a 60 months payment plan

            Just curious, does anyone know what would happen if you somehow neglected to include the collection agency in your BK?

            For example you list the original creditor but due to an oversight you don't list the CA that it was charged off to....

            I guess I'm asking because I am in various stages of collections and charge-off with various cards.

            I am paranoid about my mail and I think some things have gone missing when I moved and the post office didn't forward some things to me. And I am pretty sure some things have been lost in the mail at some point.

            I would hate to think there is a CA out there somewhere and I'm not aware of them and as a result I would not know to include them in my BK which I plan to file next year.

              Prior to filing, get your credit reports. They should list the 3rd party collectors who have your accounts.
              Try and be as through as possible but, if you list the OC, the debt is discharged.
