    Credit Card Hardship Agreements

    a relavite is considering bk, chapter 7. she has 3 cards that she has in what she calls "hardship". they have lower interest rate to zero not balance though. she is still in the red every month. she did these agreement over the phone, never signed anything. the accts all are frozen in this hardship.
    can she still have these accts discharged, even thought she has verbally agreed to have them placed in "hardship"? also she has a signed agreement with the IRS on $5K in back taxes, she pays $200 a month, has payed for almost a year and plans on conntinuing to pay. does filing BK have any effect on that agreement? can it be modified to a lesser payment? due to losing a job that paid really well she is now making approx $36k, with no assets other than an older car, so im sure she would pass the means test. her accts are with BoA, Chase, Citi and 8 other small accts. total unsecured debt is approx $60k, zero secured, rents month to month. thanks for any advise/comments

    It all depends on how much disposable income she has each month. IRS tax is not dischargeable but she could try to negotiate a better deal. There shouldn't be any problem re the ccs but I would recommend seeing a few attorneys on free consults.
