    Does an accident settlement count for means test?

    We were involved in an accident last November. The insurance company is now settling and is paying individual settlement amounts for all family members involved in the accident. The payments are for pain and suffering. I understand that this is not federally taxable, and that it is not exempt for bankruptcy purposes.

    My question is how this figures into the means test. Since each settlement is paid for a different individual, would I include the settlement amounts for my wife and I in our last six months income, but not the kids, or do I need to include the entire settlement amount?

    I'm planning on filing pro se, but have scheduled appointments with several attorneys to discuss retaining their services.

    Anybody have experience with this situation? Thanks in advance.

    if you are using the federal exemptions, there is i think $16,000 exemption for personal injury. it's not really income i think. put it as an asset and exempt it. if you use state exemptions, then i don't know anything.
