Joint Filing-My first Ch. 7-not wife's first.

I decided to hold off on filing, part on the busy-ness of life getting in the way, part fear of the process, part everything...

My wife, who also has debt that is not insignificant, has once filed (joint filing from a previous marriage) I understand the discharge was August 2002, so 7 years ago.

With the new laws being 8 years, is it calendar years? Or will a 2010 filing be legitimate? Or...should we bite the bullet and file separately.

It's 8 years between Chapter 7 filings so, she'd need to wait 8 years from her prior filing date.

Since there is a pending judgement, I guess we'll have to file separately. Most of our debts are separate and pre-marriage debts, but we were trying to minimize costs by filing together.
