    Questions about inheritance money & process...

    Okay, if I am the only one filing in my family and my husband gets inheritance money, is that considered mine as well, would I have to report it in the 180 days and could the trustee take it?

    Also, I've always wondered how it works if this happens...if your trustee takes the money to repay creditors do you then get the BK taken off of your records? I don't see how they could take the money, repay your creditors (possibly in full) and then expect you to suffer the consequences of the BK on your credit report for seven years...

    Your husband is the heir and not you. Since he didn't file, no need to report it.

    And no, the bk filing stays on your credit report regardless if creditors are repaid.

      Was your husband's income included in your house holdhold income for filing? Does your husband live with you? If so, the inheritance increases your household income. Call your attorney and ask to be on the safe side.

        Yes, my husband's income does count in calculating "household" income, but I was speaking hypothetically about the inheritance. I hope to file in November. My husband's father was just diagnosed with a terminal illness, and he could still have years to live we just don't know. I don't even know if my husband will get an inheritance since his mother is still alive, but I was worried that if something happened to his father in the 180 days after discharge it would affect MY case. From what I gather it wouldn't since the money would be coming directly to him, right? Even though it would be coming into my household?
