Discharged, but no word from the trustee re: assets

The great news is that I was discharged yesterday!

The only thing left with my case is if/when the trustee will ask for me to surrender the $4-5k of assets (cash) that were non-exempt. My attorney advised us that he may never ask for the assets, but that we'll just need to wait and see.

I could have protected the cash, but my attorney told me repeatedly "pigs get fat and hogs get slaughtered". I was pretty agressive in protecting some other assets.

Does anyone know if the trustee has a deadline to request the assets? The only deadline I can find regarding assets and the trustee is the 30 days to object from the 341 meeting.

No deadline. The Trustee can literally keep a case open for a couple of years... administering assets. I assume that you're an asset case, so... it can stay open.

Thanks justbroke. I suppose potentially waiting a long time is a small price to pay for having $2m discharged. Currently our case is showing as "no asset" on pacer but this may not mean anything.

Hmmm... did the Trustee file a "No Distribution" report yet? Or, that's what you're waiting for?

That's what I'm waiting for - well, either that or some communication asking me to cough up the money.

Understood. They are slow these days. Maybe you'll get lucky and they'll just file a no distribution report. Good luck!
