    how screwed am i?

    I had an emergency car repair that was 671$.....you guessed it I had to use a credit card. I was looking to file some time in oct. I will stop paying all cc's in august.

    I was thinking with this card i used. Would it look better to the court if i kept paying on it until the day i file bk? Sometime in oct. I most likey can pay back the money i used. Also worst case than can just ask me to pay this amount when I file correct?

    You cannot pay any entity more than $600 in the 90 days prior to filing bankruptcy. I know this because of Dh being in the hospital in April & has about $1,500 out of pocket expenses left to pay for the year. His health insurance, as of today, is still processing their payment of the $22,000 bill. We are filing 9/30/09.

    We thought we were going to file in Dec. or Jan. & met with our BK Attorney late last Sept. I had a Balance Transfer of $3,500 from one credit card to another for a lower % rate. He told me to make the min. monthly payments & add a bit each month and I did.

    If you are filing BK in Oct. Stop Paying on all Credit Cards Now. You are wasting precious money. I would use my Attorney's advice & pay only the min. pymt. along with $20-$50 added each month. Just make sure the 3 payments do not total over $600. If adding $ will put you over the $600, just pay the minimums. Or don't pay them at all. Worst case scenario, is you would have to pay only the $671.

      Nobody will care about $670.
      You are hurting yourself but, not because of a recent charge. You should stop paying all debt you wish to discharge and use that money for living expenses. You need to get used to life without a cc for awhile. What will you do post bk and have an emergency with no access to credit?

        not to bad i would think, it isnt abuse as its something you need to make a living, assuming you have a job. i used my card jan 30th for $1000 for my feb rent because of a temp work shutdown for 2 wks and filed april 17th, so far no probs, but i still have 22 days till creditors cant object, trustee has already ok'd my filing according to Pacer. the advise i was given was that worst case, i would have to pay it back. also my work hours/income went from full time to 28 hrs a wk in march, atty felt i could show in jan i had no intent to file for bk, but after work hrs reduced, i was forced into filing as i was barely getting by before income cut due to debt load. im probably cutting it too close, wish i had a few more weeks, but i was afraid of being served at work by one of my creditors and that wouldnt be a good thing. good luck

          i forgot to mention that i did continue to make payments on that card(one for $500) for the next few months till i filed to show good faith attempt to pay it back, hoping that might help also

            I think I will make a few payments to show good faith.

              $671 is too little for anybody to bother you about, and it's certainly not a luxury item, so i don't think you have any problem. plus, looks like you will be beyond the 90 days presumption period when you file. just make a couple of payments and don't worry.
