    Wow guess what I just got in the mail...

    On May 29th the UST filed a presumption of abuse on our case. Our lawyer finally met with us this past Tuesday but he was too late. On Tuesday the UST filed a motion to dismiss without prejudice.

    Here are the issues listed on the motion:

    He says dh GROSSES $6315.40 per month and that after taxes and all expenses are taken out we have $900 PER MONTH in disposable income. Dh's checkstubs clearly show that he doesn't gross anywhere near that number. He currently grosses $4600-4700 per Month and has ever since January. He USED to make $6315.40 per month but not since 2007. It goes on to state that $6315.40 x 12 is $73,942.80 which is over the median for a family of four. The median in TX for family of four is $66400.

    He goes on to state that dh's job is stable and that he is making a very decent wage at $6315.40 per month so the UST is asking for a dismissal without prejudice.

    So I call my lawyer and he's out of town but the paralegal says oh yeah we got that on Tuesday after you guys left and the lawyer met with UST's office yesterday b/c as it turns out WE FILED YOUR PAPERWORK WITH THE WRONG NUMBERS! Are you kidding me? The lawyer met with UST and took all dh's paystubs and our bank statements to show him that we don't make that kind of money at all but b/c he's out of town and will be until Monday all we can do is wait and see what happens then.

    I'm not sure rather to scream or cry. Tomorrow is payday and I have $20 left until then. Not $900 not even $450 just $20. And all I've bought is basic groceries and paid bills. No clothes, no fun stuff, nothing. Just gas, groceries and bills. And I'm almost out of groceries.

    Oh and as part of our BK we are surrendering dh's truck so the paralegal tells me to sit on it and not to let them come get it b/c if we have to dismiss and refile we may need that note to get us through the means test. The finance company has already called me wanting to come get it. I'm so nervous now.

    7/09 UST has decided to withdraw his motion to dismiss!

    I'm so sorry to hear that! I know it must be sooooo frustrating! I know its so hard to see a light at the end of the tunnel but just be strong. You can't do anything till Monday so just try to relax a little bit. Maybe buy some cheap wine.

      A motion to dismiss is not final though.

      So long as your lawyer has talked with him and worked out the numbers he may well withdraw his objections.

      If they haven't gotten a motion to lift stay granted yet they can't legally take it until you are discharged or dismissed.

      Sorry he's out of town, hope it works out. Try not to panic to much ....he probably just took Father's Day weekend off and a few more days .

        wow. this is what makes me nervous about hiring a lawyer. I am so afraid to get one who will mess us up or something. We need to retain a lawyer soon and haven't even had consults yet.

        Sounds like it will all get straightened out though.

            You didn't review the paperwork before they filed it?

                This is a serious error from your Attorney (and his staff). However, if the lawyer's office is aware and are working on it, then you should be okay.

                  Yes I did and called them as soon as I read over the papers and told them not to file b/c I needed to see my lawyer ASAP. The paralegal then informed me that it was too late. They had already filed.

                  I'm not sure how b/c the papers I received in the mail weren't signed. It's been a huge mess from the start

                          Okay I can breathe...just a little. The UST met with my lawyer on Wednesday. My lawyer informed him that the papers were filed with incorrect numbers. He submitted the correct I and J which shows only $15.00 left over every month and provided paystubs from January to the middle of June to back it up.

                          The UST now says he will wait for dh's paystub at the end of June that way he can see the past six months of this year and then he will make his determination. My lawyer said he is looking at the continual decline in dh's Overtime and wants to make sure it's staying the same or less every month. Since dh's hours never change his next check will be the same as his last check.

                          I'm now hopeful that he will eventually withdraw his presumption.
