    Hoping someone can guide me

    First, I turned in the papers March 27th for ch 7. I am not sure if my lawyer has filed yet. Is there any place I can check that does not cost?

    I also have to move by march 31st. I am hoping I can find a place. I have been up front with the fact that I have filed because I don't want to pay a credit check fee just for them to say sorry we can't help you. What do you guys do in a case like this?

    Now, I have to move when do I inform my lawyer? Before or after I find a place?

    You can open an PACER account and check and see if your attorney has filed. You will need a CC or debit card with a visa/MC logo to open the account immediately ( rather than waiting for a password in the mail) but if you do open immediately, you can search for your name on your districts site and see if your petition has been filed. It costs 8 cents a page to view, they don't bill you until you have reached 10.00 in fees.

    OR,

    You can go down to the local BK court and use their PACER terminal for free

    OR

    you can call the BK clerk and ask

    OR
    simply call your attorney and ask if he has filed and what your case number is.


    Are you having to move because of foreclosure? You might tell your attorney you are looking for a place and once you have signed a rental agreement, give him the info ( amount of rent and address) so that he can do an address change for you so you are sure to get all correspondance from the BK court.

    If you are moving due to FC, you may have longer than you think you have since you have filed BK.

        How the hell can a LL justify raising rents in this economy!

        Bunch a weenies! I understand that ARMs are starting to readjust, but there are a lot of investors sweeping up bargain properties and offering them as rentals.

        I hope you find a much better place at a less expensive rate and your old LL has trouble relplacing you as a tenant. ( not very nice , I know, but jeeze, come on, it is not like we all just made a mint in the stock market and are sitting pretty)


        Rents are starting to go down where I live by a couple a hundred a month for a 3 bdrm. You'll find a nice place, hopefully better and less expensive.

        Craigslist is a godsend for rentals. Check there first.

          Thanks ding so do I. 1217 for a one bedroom seems outrages to me. Do I let my lawyer know I am looking or do I wait until I find a place?

            Since your rent amount will most likely be the same until he files, which should be before your move date, unless he is a big time lagger, your petitions shouldn't have to be changed. It is probably always best to keep your lawyer informed of everything, it wouldn't hurt to tell him.


            You are still paying the same rent until you file, so I don't see it as a big issue, but you do want to keep the BK court informed of your new address and your lawyer will have to file a change of address, just in case any of your notices to creditors sent out by the BK court are returned undelivered. They use your address as the return address, even though it comes from the BK court. That way none of your creditors can say they were never informed of the stay and in the chance that something is returned undeliverable/wrong address, you will be able to notify them properly.

                I was in foreclosure and filed chapter 7 and just found a rental house. I even was approved by one rental agency, they just stated as long as you dont have collections from previous landlords or utilities companies, there would be no problem being approved no matter what your credit score. That, and the fact that your income must be three times the rent. I didnt have any landlord collections as I owned my own home, so instant approval! In the end I ended up renting from a private owner, and let me tell you, that process is actually alot more complicated. Good luck!

                    Thank you all for your responses. I am still looking. I hope I find a place in time. I have great rental ref. I hope that will be all I need but we shall see.
