    Opinions on how you think my 341 will go...

    I am only about 500 under the median (because of a one time bonus in December). My schedule J show 196 in disposable income however, in the section about additions or subtractions with in a year of filing, attorney has listed the birth of my child in October (which my monthly insurance premium on health will triple, as well as diapers, formula, etc.). Attorney is trying to still get me in a 7.

    Anyhow here forced to go into a 13 if you had a positive disposable income even w/special circumstances to follow?

    More info, even if they forced me into a 13, creditors would not really be getting money because of my federal tax bill I owe, and I'd only be in a 3 year plan (under the median), AND, my tail will be back at the end of the year to convert to a 7 because I will be about 12,000 under the median without the bonus, and an extra mouth to feed (offically) in my family.

    341 not until 3rd week of May..is a long time to worry about such things. : (

    Why didn't you wait for the december income to fall off?

      I wanted to intially, but the calls coming in to my job were out of hand. Also, I have no privacy to really say enough to get them to stop. I'm under an enormous amount of stress (from things other than my bankruptcy), and also pregnant. I needed to get the calls off my back, and prevent garnishment.
      My dmi is at 196 right now, but in my filing, attorney states the issue of my pregnancy...we know my monthly insurance premium is going to triple starting in October when baby comes, and I will be thousands under the median then too with the addition of a family member. Also, when baby comes, I will then have a family of 5 ..and we currently live in a 2 bedroom apartment..so my housing cost will go up (currently have a boy & a girl sharing same bed & same bedroom, this has to change anyhow as they are getting older). Attorney is thinking they may give me some grief, but with it being so obvious if they put me in a 13, I'll be back in October to convert, that they may approve me for the 7. I also owe 3500 to uncle sam...even a small 3 year plan wouldn't cover much more than legal fees & my taxes anyhow. I guess I'll have to see how it plays out. Over 4 weeks to go before the meeting..is adding to my stress level.

        Looked over my actual petition (some changes were made after I left), and my medical was off by 35 dollars. I asked my attorney how much impact would this make (having 196 dmi on paper verses 151, etc.) Attorney said is would not make a difference. Though the presumption was not present and we didn't have to complete the means test...if they object and want me in a 13, if she were to complete the means test, I'd totally pass that. Put that on top of the fact I will have a 5th family member w/increased healthcare premiums, diapers, food, clothing, formula in 6 months from now, she things we are probably okay, else I'll be back in 6 months to simply convert. I guess I need to stop worrying about something I have no control over at this given time.

          Did you know that you can send your creditors a letter stating that they can not contact you by phone at home or at work, and that all further contact must be by mail. I'm not trying to give you a hard time, I just want to make sure you know all your options. But I hear you, the stress is crazy and I want this over and done with now too! Make sure you are taking care of yourself and do whatever you can to reduce your stress level, I can't even imagine being pregnant and have little ones to look after at such a stressful time.

            In the district where I practice, if you've got $200 or less in disposable income, it's typically not a problem.

              thanks for the advice/info everyone.

              Yes, I know about sending creditors letters, etc. I just so many of them (had a bad 10 year marriage..and in divorce/separation was left with the brunt of the mistakes).

              I just wanted to get the ball rolling on this. And knew it would make me very borderline, but w/my special circumstances, hoping I could get approved. Either way, I'll end up approved for a 7 even if I do a couple of months of a 13, it will get converted hands down after baby comes.

              I do feel a lot less stress since filing, which helps me focus more on having a healthy pregnancy.
