We have been told we qualify for Ch 7 because we are below the median income but we haven't retained a lawyer yet. We moved out of our house and we are planning to surrender it. I'm worried that now that we have reduced our living expenses we may be pushed into a Ch 13. Thanks.

You would have to do the paperwork or means test and see what expenses you have and what you are allowed for your state, size of family etc. Basically, after all of your expenses you are negative or have very little left over you will be put into a chapter 7. If your worried about the house payment not being a factor try rent a apartment at about the same rate to keep you in a Ch7. -
we never did a means test because the attorney said we didn't have to. she said we automatically qualify for a ch 7 because our income is below median (this is Arizona). I'm not sure if our monthly expenses are even calculated but maybe they are.Comment
