    90 day thing

    On feb 9th or 10th i used cc checks to pay business ins ($2,332 worth) and spent 368 total on another one on jan,22,26 and feb 10(204 on paint thats what i do and 165 on old cards on ebay) and spent another 171 on a paypal card for other old cards and i asked the lawyer if i should try to pay thoughs things back because of what i read and he sai d no dont waste your money stop paying all of them($89,000 debt)im scared it might bite in @ss what do ya think besides i dont shut up thanks

    I think you should do what your lawyer said to do.
    how long before you file? 3 or 4 months?
    your should be fine the cards were not used in a fraudulent manner you were running your business.

        Assuming you have an experienced lawyer, he should be familiar with what raises flags in your area. If the creditor were to object, it only pertains to the amounts of your recent activity, but you'll be outside the 70/90 day rules by the time you file I think. We don't see on this forum that creditors object much...

          So what if you have to pay those recent charges back. You're discharging 89K so if you had to pay a few grand back on a payment plan you're still way ahead.

          This board is great but when it comes down to it you need to listen to your lawyer. The people on this board only know what happened to themselves and others they've spoken with. Your lawyer has most likely seen 100's of cases and dealt with the trustee so his/her advice should be the one to follow.

            Because there is a lot more to this then just paying a couple of grand back. This would involve a creditor objection for fraud possibly criminal charges. 90% of what is talked about on this board is BK planning. What I take away from this thread is someone asking how to avoid the appearance of wrong doing.

              I made charges within 90 days and I transferred balances within 6 months and people on this board told me to wait to file. I also made a couple of payments of over 1k to 2 creditors. My lawyer said it wouldn't be a problem.

              Guess who was right?

                I called anthor firm today and legal aid or whoever she was (not lawyer)said i should wait 90 days but i set up meeting on 10th cause hes booked and she said he would no better and she also said it might be in my best interest pay minium payment on those cards

                  Also the lady told me to bring some paper work so during the free consult the lawyer will have a good sense of what to do and she made me feel much better For the lawyer had me bring nothing in and only wants 2 yaers o returns to start with the new one told me to get house appraisl bring morg info, bank statements all cc bills and deed 06,07 returns cause i didnt get my new taxes done yet and since im self empolyed it might be good idea to defunt my buisness and start new one and old buisness cc debt could be included in my personal bk
