    This is crazy HELP!

    I am having severe problems with the credit union. They are refusing to remove my overdraft protection and creditors and payday loan companies keep taking money and making my account go under.

    I asked them to remove the overdraft protection and they refuse. My account keeps going more and more under and I have no control.

    I have a new bank account somewhere else now but I am really concerned about all these overdrafts..

    For example.. Friday I wanted to deposit 140.00 into my credit union for my biweekly car payment. My account was negative 80.00 when I checked it so I had to deposit 140.00 plus the 80.00 just to try to pay my car loan. Then the credit union refused the payment anyways.

    I am afraid they are going to take my car. I checked my FICO this morning and now it is in the 400s!!!!!

    I am so depressed. I am never going to recover from this not even through a chapter 7.

    How are the creditors taking the money out of checking? Are they affiliated with the credit union?

    If you have any automatic deductions, cancel them immediately with the creditor. Go to the website and cancel or call them.

    If you wrote out post dated checks to payday loans, you have to honor them or be accused of passing bad checks. Put a stop payment on the checks.

      From what I've read this is not true and these can be discharged?

        I did not write bad checks to them. They automatically take out the money and I do not know what to do to stop it. I have no money and they are going to try to hit my bank tomorrow!!!

          Yes, can be discharged when BK is filed. But, sometimes payday places take post dated checks to cash and will try to cash them if there is no filing.

            When are you planning to file?

            Can you just close the account, pay your car payment with cash or money order at the credit union? Ask the attorney what to do if they don't take your payment. There must be others in this same boat.

            Maybe someone else has dealt with this before, but I would just close the account, tell the cu that you are filing and list the account overdraft as a creditor.

              You have to max out the overdraft and stop using the account, cancel the automatic payments that you can and start paying the stuff you want to pay from another account or with money orders.
              filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!
