A credit card to charge for services in a bankruptcy?

Hello,

I am new to the Chapter 7 world and am in the process of choosing an attorney in Florida.

One i came across, stated that i could use a credit card, and he would then have to wait 90 days to file. What gives?

This doesn't seem right and seems to be fraudulent. Right?

My gut says no to this.

Hi gogetter76, welcome to the forum. I haven't heard this one, though it is standard practice to wait at least 90, better 180 days from the last use of a card.

Our attorney took payments. We made a down payment by check, and then followed with another check a couple of months later.

But I'm with you. If your gut is telling you "no.... " it's probably wise to listen.

In any case, you need to consult with/interview at least two or three more. We hired the first one we talked to, because she seemed to be very knowledgeable, and seemed to have a very caring ‘bedside manner’ and would be easy to work with. Boy, were we wrong! But we made it through and so will you.

You are right! Sounds like he/she is getting you to charge the fees and then get the fees discharged in the BK

Wow... Every consult I went on I asked if I could pay by credit card and they all laughed and said "NO", It would definately be fraud since you are charging his retainer with the advice to discharge your debt. This sounds like a very fishly lawyer and I would stay away from him.

That is what i thought. I won't be going with him!

I found a laywer who i can make payments to. I will put down a retainer and in 3-4 be paid off to file.
