Average Attorney Fee

    I'm in Fl and my attorney charged $2675 for everything (CH 7). It would have been another $1,000 to file a CH 13.

      I'm in NY but Western District-not downstate
      our attorney charges us $1200 total (including filing fees) for CH 7. He said when we decided to convert that he would not be charging addt'l fees since he could have done a better job in helping us to plan for filing (perhaps waiting an extra month or 2 so that it would be at least 6 months since we did a CC BT). Honest guy.
      11/18/08 filed CH 7; 341: 12/11/09, cont'd to 01/06/09
      03/21/09 341 hearing for CH 13
      04/27/09 Confirmation hearing for CH 13
      $199/mth for 60 months + $9K 2008 income tax refund

        When it comes to BK, the phrase, "you get what you pay for" does hold true. The attorneys that work on volume and charge less than $1500 (that figure will vary depending on the area), simply CANNOT provide the same level of service as firms that charge more. Granted, not every attorney that charges more is worth it, but by and large, those that charge more do earn it. The Court ultimately oversees attorney's fees, if there was an attorney charging too much, they figure it out pretty quick.

        I typically recommend going with firms that charge the "Same" for a chapter 7 or chapter13, that way you eliminate the counter-incentive for the firm to place you into a 13.

        Bankruptcy is not a commodity like Milk. Unfortunately, as many have found out on this forum, the success and stressfulness of your BK is very closely correlated to the quality of attorney you hire.

            I totally agree. I would rather pay a little more than deal with some of the horror stories I have read on here. This attorney assured me, I will only deal with him directly and not a paralegal. He is a boutique lawyer with 17 years experience. I liked him because he did work as a trustee for 7 years so he knows the system in my local court. He even told me I could shop around and get someone cheaper but I would not get the personal attention.

            What really sold me on him is when I began to ask him his strategy on protecting my lawsuit asset. He explained, in detail, how he would do this and was honest that there are no guarantee's. Also, he was not pushing me to file. He basically told me "Let them come after you, they may not". Most of my debt is business so it currently does not show up on my credit report.

              Just for the record I'm looked into this here in NM and the range is between $950 and $1200 for a no asset chapter 7. (+filing fees). I didn't call around; I looked on Pacer and and checked a bunch of cases to see what they were charging.

                we were also in OC we paid 2100 + the filing fee but it was worth it compared to the chain ones where they send a attorney you have never met. We met with our attorney as many times we wanted so it was worth the money. Also we weren't as nervous as there were other people in the CH 7 court that didn't have a attorney show up, came late or the attorney was calling out names looking for their client-I was def glad we choose to go with the little more expensive route definitely worth it.

                  I was quoted $1500 - 2000 for Chapter 7 depending on complications and $2500 for Chapter 13, plus filing fees & CC. I'm in the Western Dist of OK. This attorney has no paralegal; when I call I talk to her directly and the initial consultation was 3 hours (wow) and we went through the means test and she answered all my questions. I went in believing I could only file Chapter 13 because I'm over the median, but she said we need to look at Chapter 7 first which was wonderful.

                  I have another consultation on Monday, but was very impressed with her and she will be a hard act to follow.

                    I am in the midwest (Missouri) and my single petition was $1600 with the filing fee. That seems to be the low end from what I've seen in this area.

                      Our lawyer quoted us $1500 for a Chap 7, $3500 for a Chap 13 - filing fees,classes etc are extra.

                        I paid $1,600 (+filing fees) for a great lawyer located in Los Angeles. He specializes in BK and so far, he seems to be spot on with everything. He's real easy to contact as well.
