    NEWSFLASH! Trustee wants 2008 Taxes!

    Trustee sent me a letter and wants my 2008 taxes. Wow - and my case is closed!

    LMAO - I thought I was getting a large return back but turns out NOT. She's not getting much if anything at all.

    Lol. They can have mine - I have owed taxes every year for as long as I can remember and I claim 0 dependents... I have no idea why I always owe and neither does every person that has done my taxes. I guess Im on the "cusp" of income levels or something...

      Me too

      Although it was never mentioned at my 341... our trustee contacted our lawyer and stated she's taking ours, too.

        I just did our taxes yesterday, so I emailed our attorney and he said there should be no issue with filing our taxes and getting our refund. (knock on wood). I'm in Southern CA.

              Danaf - That kind of stinks. Did they give you any kind of form at your 341 about turning over taxes? Did you have any room in your exemptions? I am hoping we get to keep ours (expecting around $6k total). I read somewhere that often times a trustee will abandon a refund if they see you have enough exemption room to cover it, even if you didn't list it as an exempt asset.

                i thought once you are closed and discharged that they cannot request any money, except for inheritances? Can you take your income afte you are closed and discharged? If so how long can that go on for? These trustees are blood suckers. How do they sleep at night?

                  I want to do our ASAP as I am in California too and the State is issuing IOU's on refunds. How did you get all your tax info together so soon?!? I'm still waiting for all mine...

                    I've read that a Trustee can take your refund if it was WITHIN the year you filed. Since danaf filed in 2008, the taxes (that the Trustee is requesting) are for that year...bummer

                      Yes - I did get a form but I honestly thought it was for 2007 taxes which I had spent long before my 341 so I thought it a wash. I got back 1500k+ for 07'. DUH! So ok, fine....trustee wants 08' taxes. I'm really ok with this. Wasn't depending on it at all. Adjusted my withholdings for most of the yr with not alot being taken out. It was only in the last few months I re-adjusted for more taxes to be taken so I wouldn't owe anything.

                        Everyone should be adjusting their withholdings! Don't allow the government to keep your money all year and then be at risk for the trustee to take a large refund.
                        I see so many posts on this forum asking about tax refunds and the simple solution is don't get one!

                          how much is the tax exemption for Ca. joint taxes about to file chap 7. thinking about filing taxes first. which one is better. tax and bk or bk and tax. expected 5k. wanna keep it all lolz

                            This is true for the most part - esp. if one has already filed BUT for those who have not yet - less witholding can give one more disposable income which can affect your schedules and maybe your means depending on what you make. So those on the cusp of a 7 v 13, be careful. You've got to figure the numbers out.

                            It's a catch 22. The system really screws us middle class. Nothing like kicking a person when they are down. I usually do my taxes Jan/Feb. This year I think I'll wait until April 15th. Also - interest on student loans is deductable but I'll have to check because while it is deductable, I don't think it is a requirement to deduct - I think that is a choice. I might just not deduct the interest which would mean less for trustee to have.

                              The trustee can have my taxes... Federal, state, property tax, sales tax and all of the other taxes that I have to pay...
                              Filed 8/08 - Discharged 11/08! Not tracking FICO.
