    341 Meeting Tomorrow Lawyer Won't Be There

    We have our 341 meeting tomorrow and received a phone call from our lawyer today. He said he has an emergency case, so will not be there. His partner, who is a tax lawyer will be there instead. Will this be a problem?

    Our lawyer said that it should only take a few minutes. He said to answer questions with yes/no answers and do not offer any other info. He said that the trustee may ask for more information/paperwork, but he said that shouldn't hold up the case. Is this typical?

      Our lawyer was not there either as she is 120 miles away and paid a stand in. There was no problems at all. After the meeting the stand-in talked a little with us and told us things went well. Our troubles came later. 341 piece of cake. ‘Hub

        I will just add my 2 cents to what 'Hub posted. Be sure you have your photo ID, typically driver's license, SS card, and if you and your spouse use different names, a copy of the marriage license as well. Be sure that all your IDs are up-to-date and show your correct names as you are using them. Common misspellings should not matter, things like the correct name is spelled with 2 'ns', and is commonly misspelled with 1 'n' should not be a problem. That is why the SS card is required.

          My attorney won't be at mine next month. He talked to me on the day I filed about the attorney that will be with me at the meeting.

            We were also told that the attorney that we first met with and who reviewed our papers before filing(paralegal did most of the work) will not be the attorney at the 341. We have no idea who will be there but I am sure with how prepared we are that it will not be an issue. I do kind of wish we had been informed of this pre hiring of the attorney. The more I read though the more I see this is fairly common.

              In the end, for most people, the atty is at the 341 for handholding purposes only. You, the debtor, answer all the questions anyway; it's rare for an atty to take a significant role in a consumer-debt-only 341, from what I understand.

              However, you do want to give the trustee any information requested, if you know the answer. Restricting it to yes/no answers is a bit extreme, and you don't want to piss off the trustee or make him think you are deliberately withholding information.

              The trick is to give ONLY the info requested, do NOT explain unless asked for an explanation, be as brief as possible, and don't offer any extra information. The reason for this is because the trustee can ask you anything they want, and have been known to quiz people at length based on information offered by way of explanation, if only because this is the first they're hearing of it. So don't worry about it, feel free to ask him to repeat or explain any question you don't understand, answer as simply and briefly as possible, and you'll do fine.
