    FL Exemptions?

    I am still coming to terms with the fact that we are filing BK. I am trying to research what I can and I have a massive headache in the process. Does anyone have any advice or resources for FL exemptions?

    This is new territory for me. We have tried and tried to make this our last option but now it is our only option... Thank you in advance.

    Becca, I'm asuming that you've lived in FL long enough to be eligible for Florida exemptions.

    If you're filing with an atty, he will be able to explain the exemption process to you and tell you how to make the best of it.

    I filed pro se (without an atty) and even though I had to use another state's exemptions because I had not lived in FL long enough to qualify, I researched many local cases to see what needed to be filed and how, and to be honest I saw case after case where the person only owned a TV, a couch, and a car. Seriously. I did not see cases where household goods were listed and/or exempted beyond one or two items... and as I'd read through the case, I'd see that usually these items were purchased with secured debt, which is why they got included.

    I'm not saying leave stuff out or anything like that! Only that when I researched local cases in FL, filed with FL exemptions, property listed was amazingly sparse. And these were atty filings, by good attys, so I'm assuming they knew what they were doing because their cases didn't have any problems. Just FYI.

    My primary recommendation to you, if you are considering filing Ch7, is to get the Nolo Press book (see my sig for the link; I'm a *very* happy customer ) or one of the other popular Ch7 how-to manuals: they are easy to read, explain everything thoroughly, and will give you an education in bk that you just won't get elsewhere. Even if you file with an atty, it will give you the knowledge to be able to use his services wisely, to know when something is out of line or needs to be addressed, and what to expect at various phases of the Ch7 process. Seriously, if you're even thinking about filing Ch7, one of these books will be the best $$ you ever spent. Good luck!!!
