Really Confused - Reaffirmations!

    I am betting my CU will say the same thing on my car. I am with danaf, my payments were never late and are current.

    It's good to know that if I do reaffirm, that I need to make sure it's on the credit report that they report to the credit agencies.

    I am still a little confused why my attorney said I need to re-open the case and change my paperwork if I change my mind on reaffirming.

      I did ask if they will report the payments and they said they will, but thanks to this forum, I will triple check.
      danaf, make sure you are really upside down. I though i was about 6k under (attorney's said this) until i called around to see how much my vehicle would truly cost...apples to apples, with tax, title, etc, it was pretty much the same plus a very baery bad interest rate. The gentlemen i spoke with at the dealers were kind enough to tell me to stick with it.

        I honestly think it's all bs bully tactics. If worse comes to worse, I'll just give it all up and find some beater to drive around. Seriously - after what I've learned on this board - I'm sure as shit not going to let some credit union bully me around. They've got no power although they'd like me to believe they have. I'm making the payments ontime - they want their money. That should be the end of the story.

          I definitely would not re-affirm the stove. You said it was home depot. Home Depots credit cards are handled by citicard. Citi does not want your stove and I find it unlikely they will come get it.

            I really agree on the stove, I think my atty didn't want it to look like fraud, but it's not a luxury purchase, a stove is a necessity. It might be different had it been a computer or a TV or whatever.

            So, if I decide not to reaffirm do I need to say so at the 341? Will they ask me there? If I say no, I'm not going to, will that make my budget out of whack even if I'm planning on making the payments?

            I understand they can't even contact me regarding the reaffirmation until after discharge, is this correct?

                I've had my car 2 years. I will probably plan on reaffirming it. I've talked to several car dealers who have recommended keeping it.

                    Well, i might have to take back that this is a smart decision. I went to segn reaffirm paper yesterday. No WHERE did it say they would report it to our credit, when i called, they basically said "oh well, and you'll have to take our word for it" Not to mention a $350 reaffirmation fee. I still was going to do it even though i was frustrated to no end and then i actually looked at the paper work, after looking at what the lawyer wtote on last page i fear it will require another hearing and hold everything up, so now am reconsidering and probably willjust give the car back once i can find a decent one.

                      2confused - where is your car financed? A bank or credit union?

                      Is it the financial institute who is charging $350? That's insane. I wonder if this is common practice.

                      I will not pay $350. That sucks.

                      Did your reaffirmation papers come in the mail? After your 341? I'm still not clear on the paperwork flow for reaffirmations.
