You have to list this debt on your bankruptcy petition. However, if no one is currently paying this bill very little changes with a bk filing. Right now they have to right to reposes their stuff and they would in bankruptcy as well.

As a practical point creditors who have a secured interest in small things life furnature, appliances, computers, ect. rarely ever come and get their stuff. Like the big bad wolf they huff and they puff, but they never really blow the house down.

However you are right if worse comes to worse you can reafirm this debt in order to keep the underlying secured property. And you also right you need to list every debt. Leaving this one out is not an option.

As for where the things bought with that card should be listed - under gifts given or under your assets, I really don't have the answer to this question.

I thought you were using a lawyer through legal aid in your area? Are you putting everything together yourself to get an idea of how things work, or are you going to try and file without a lawyer (pro-se)? Make sure to tell your lawyer off all of this so they can make sure that all bases are covered.

I'm not sure filing bk would be in your best interest at the moment. From previous posts, you aren't working and your income is exempt from creditor seizure. You still have ongoing health issues. I'd wait until you've recovered enough to hold a job that has healthcare benfits. What happens if you file and require extensive medical care post bk? You'll not be able to file on those new debts for 8 long years. Save the bk for when you may really need it.
