2 cards not listed on my creditors! HELP!

    2 cards not listed on my creditors! HELP!

    I just noticed that 2 cards (both from 1st Premier) were not listed on my list of creditors. Both are maxed out and my intention was to keep these since I have never missed a payment on them and I was never over my limit on them until this month.

    We filed ourselves, but we had our paperwork done for us by Volunteer Legal Services for free. I just assumed that they took it off of the credit report that we gave them when we originally started this so I ddin't write it down for them.

    So what do I do now? Just leave it or do I have to file some type of addendum? We live almost 2 hours from the court house for our district even though our 341 is being held closer to home.

    Why on earth would you want to keep 2 maxxed out cards?
    Of course you should amend your filing to include these creditors.

      You will need to file a admendment to include this creditor in your petition....

      Since you filed pro se, you might check with the clerk of bankruptcy court and see what form you need to file to add another creditor and ask if you can do it by mail and check....

      Will cost you like $26.00-29.00 to add a creditor along with the correct form....

      Need to do this before the 341 meeting tho....

        You will have to file a motion to amend schedule F for unsecured creditors, you will want to make sure that all your creditors are listed as the court fee to amend is $26.00(in my state). You can do this before or after the 341 meeting, it is better to do it as soon as possible. Be sure to obtain all three credit reports, you can order them once a year at no cost at www.annualcreditreport.com Keep in mind not everything in on the credit reports but a good way to check. Be sure to include any account written off as bad debt as well. Should you forget a creditor after dicharge it is more expensive as the case will need to be reopened and the fee to the Court is much higher.

          I wanted to keep these cards because I have a good payment history on them and I thought that this would help us after the bk is done. Plus I doubt I will be able to get another card anytime soon because we filed on so many other cards (cap 1, orchard and so on) most of the major ones so the chances of them actually giving us another card are slim to none!

          We didn't have to pay any filing fees when we filed we qualified for a fee waiver. So will that apply when we ammend these?

          Do I have to drive 2 hours back down to the federal court house or can file the ammendment at the court house where our 341 is taking place next Monday??????

          Not only that, I have gotten 5 creditor notices back in the mail from notice that the court sent out. I used the address' that were listed on my credit reports and from the collection letters I received. So how is this possible???????

          I am getting frustrated, I just want to make sure that everything is on there so I can start pulling our CR's and cleaning it up.

            Plenty of people have gotten Premier or capital 1 cards after discharge dispite having declared bk on those creditors in the past. Don't shoot yourself in the foot by holding onto debt. Your credit should be the least of your worries right now. Right now you need to be working on getting your finances in control, learn to live within your means, and make a good go at your fresh start.

            Additionally, you cannot pick and choose which debts to discharge. Legally you need to list all creditors.

            As for the address. Try calling the company to get an accurate address to send those to. Try looking at old, fairly recent, statements to find a phone or address.

            Other pro-se filers will hopefully help you out with the others.

              amend the petition and get rid of the debt load on the 2 cards...26.00 alot cheaper than what you owe....they may cancell the cc accounts anyway once they find out you filed...
              read the stickie about credit repair....you wil be able to get credit again....I had a national
              city card with a perfect payment record....listed the debt as they would have cancelled my card no matter what......good luck and god bless you.....guzzie

                1. you must ammend the schedules to reflect that debt it is 26.00 and no that can not be waived.

                2.you should be able to get another card within the futre after bk.

                3.the ones that came back BEWARE you must get the correct address. File a Certificate of service stating that you ammend it to the correct address and then change the address of the creditors on the matrix. Be sure to do the certificate of service very simple put certificate of service at top. put courts name and district debtors name and case number then put I _____ certify that I did in fact mail by first class mail a copy of the notice of filing chapter 7 bankruptcy and 341 meeting to the following creditors on todays date sign and file at the courts your case CAN be dismissed if you do not do this.

                  I really appreciate the info, I was getting worried especially since our 341 is this coming Monday! I was planning on sending the ones that came back by certified mail. So then from what I can see from the post I have to file this with the court as well?

                  This can get so confusing. I wish we could have afforded a darn attorney, I do not need this headache!

                  I will get online and get the forms to add the credit cards.

                  So just so I am straight on this:

                  1) I need to file an ammendment to which schedule to add the 2 missing credit cards?

                  2) What form do I actually need to give the court the correct address for the ones that came back?

                  I am so glad that this website is here! I would be lost!!!!!!

                    1. At a minimum you'd have to file an amended Schedule F. You should consult with the clerk of court though first to see what the local rules are. Some want everything resubmitted others don't. You'd also have to amend the Summary of Schedules.

                    2. First take out the bills etc that you have and compare the addresses to what was sent out. Make sure a clerical error was not done. Given the fact so many were returned it is likely your 341 will be continued to allow them due notice. Also make sure you sent them to the right address listed on bills etc, most of the places have a separate payment processing address and correspondence address. Needs to go to the correspondence address. If the address you have is the one that was rejected. I would gather those bills up that shows that address and the returned mail and take it to the 341 with you. This way you can show the Trustee you tried to contact them. If at all possible find out their current addresses and get those back out. You'd need to modify your creditor matrix to include the amended addresses.

                      The courts have a change of address form in the office you just fill it out. But do the certificate of service.
