We are slightly behind in rent. We have the money to catch up but I read if you pay the rent before you file they may ask the landlord for it back. Also, due to breaking my left foot and fracture my right ankle I have to move to a single level home, I have 4 kids and I can't to up the stairs. since we may have to move anyway due to Chapter 7 will they allow us to move right after filing, this will benfit my family in a lot of ways beside the fact I can't take the stairs (can provide a statement from my doctor) but we could find a rental home for less and save money, I can't work until at least one foot is healed.

If you list the landlord as a creditor so he is also under automatic stay so file the day after rent accrus again and move before it is due again the next month so that way you are not adding up new rental charges after filingSometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

You should be fine paying regularly due rent. If you pay rent ahead several months and that is not your regular practice you may run into problems.
If you owe back rent I'm not sure how that would be handled, but someone wiser than me is sure to respond.
If it is just a situation of being a few weeks behind on your regular monthly rent you are fairly safe in paying it.Filed: 10/26/2006
