    URGENT: Gotta KNOW by Monday

    ok, I filed chapter 7 and have been discharged, last august. My car, was included in the bk. I DID NOT re-affirm. I no longer want the car. I called the bank, told them didn't want it and they told me to take it to a honda dealer in my area. I tried doing that last weekend and they, the dealer refused to take it. I called Honda the following monday, and i told them they needed to pick it up at my apartment complex and they asked why i didn't take it to the dealer and i told them they would not take it, and honda bank was closed on saturday when i tried.

    they said they would send someone out to pick it up this past monday or tuesday, that came and gone. i called thursday at noon and they said someone would be out that evening or friday (tonight). car is still in the lot AND the complex put a green sticker on it saying it will be towed off due to no plate( i turned that in to the dmv). I plan on cancelling insurance monday on this thing retroactive to today.

    if the complex tows it would i be liable for anythig? I can care less what happens to the car and i have turned in the plate. it was completely discharged in a chapter 7... honda is jerking me around. i can't afford paying insurance on it any longer and the registration is due along with inspection... seems stupid to renew that stuff if it's going away any day now....

    if i am responsible somehow for a towing fee, i will move it to my freinds house and park it, still cancelling the insurance....since it's in a bk ch 7, i think i am free of any responsiblity if i don't drive it.... i gotta know my option by sunday night, cause monday it will be towed by the complex. i don't want the complex knowing about this bankruptcy as well...

    any thoughts????

    As long as the car is in your possession you are still responsible for it and the Tow Company will either send you a bill - eventually might go to collections if you don't pay. My suggestion is just drop it off at the dealers when they are not there, tell the Honda People who are going to repossess where they can find it! End of Story.

      well i tried leaving it at the honda dealer up the road, and they wouldn't have anything to do with it...


      it's funny, honda has screwed this (picking car up) up 3 times now.... it's like they don't want the car. i even told the woman, that "remember, the car is gonna be towed by the complex on the 12th" she got upset at moe sort of like I didn't have to tell her 6 times. she promised the car would be gone by friday morning and it's still out there now........ idiots.......

      i don't want it either.


      i guess i'll stick an extra plate on it and drive it over to my friends house, cancel the insurance and be done with it... i absolutely refuse to pay insurance on a car that is just sitting somewhere, unregistered, that's dumb in my book.... if something happens to it, oh well.... i tried and it was included in bankruptcy..... what's the difference of that versus defaulting on the contract by not having insurance.....

      nothing i think....

        They cant do anything about if you just leave it there, don't ask for their permission either, leave it overnight when no one is there. Its unregistered RIGHT ? ? ? They can't track you RIGHT ? ? ? The lady at the dealer already told you that THEY were going to pick it up but keep putting you off RIGHT ? ? ? Well JUST LEAVE IT THERE ..

          ok, well if it doesn't disappear by sunday night, then off to the dealer it will go, locked in the service lane waiting for monday morning. what a surprise..... honda financial told me they told them about it last saturday, but they didn't have a clue..........

          what's the worst that will happen.......

          famous last words...

          i'll just leave a note on the dash in plain view:

          "for honda financial"

            I would leave a contact person name (mentioned above) and THEIR PHONE NUMBER on the car !

            Honda don't want the car they'd rather have the money !

              well, they finally got it wednesday night.

              i called them, told them i cancelled the insurance and registration (i still had insurance so i lied to them) and they got someone out real fast to take it. they wanted me to sign a voluntary repo form, i declined, they still took it once i got the lender on the phone and told them i would not sign it.


              i cancelled the insurance the next day...

              free!!!!

              The car was mint when they took it off, let's see what sort of crap they try to pull...... hopefully i am overly paranoid...
