So last year 2013 i ended up owning IRS $2500 and the state $550, I payed state on the spot and started sending money to IRS when i had extra. This year 2014 with a few adjustments looks like i will break even with IRS and get back $900 or so from the state, can i use that refund to send to IRS or does trustee get it? Year before 2012 i was married and got money back which i did send to trustee but I'm on month 52 in my BK and want to get all my ducks in a row regarding money owed to IRS.

The year after we filed BK we owed the IRS about $2K and any refunds that were due us were applied to that total automatically. So the trustee nor I saw any of it. The trustee would not let me use the state refunds to help pay it off though. I would call your attorney to make sure, but I am willing to bet it is common practice.11/23/'10-filed ch 13. 1/6/'11-341, confirmed. Below median. Plan completed 11/30/2015. DISSCHARGED 4/4/2016.JP
