    So Frustrated!!

    I thought we paid our last payment last week after 4-1/2 years. I'd been trying to get an update from the Trustee after the website showed that we've overpaid by $800. I got a response today from the Trustee's office saying that they did an audit, that it "appears that a Proof of Claim was entered in our system incorrectly. You should be completing in 2 more months." No details as to what was incorrect or anything else. We have a new lawyer as of the new year, as our former office went out of business or something, so the lawyer isn't much help right now. After hours and hours of wracking our brains and scouring our files, I think we figured it out. One of our car leases was showing on the website as secured and not part of the Chapter 13. When I looked at the actual Proof of Claim document on Pacer, it should've been unsecured and added to the Chapter 13. However, we know that we paid that directly to the loan company, because it was for additional mileage that we used. We would've had no idea that it would be added to the bankruptcy. Now we just have to somehow prove that we paid it directly......

    I was so excited that we were done....of course nothing is as easy as it seems.

        And of course this all goes down on a Friday afternoon, so there's not much that can be done until Monday when we can get a better answer from the Trustee's office. I don't want to get too ahead of myself until we know for sure what was entered incorrectly by the Trustee's office.

          sorry to hear that. i'd be upset, too. hopefully on Monday your Trustee's office can give you more information. i too am awaiting discharge and hope they alert me asap to anything they find in their audit.

            Look at your plan and your order approving the plan. If the plan provided that you would pay that debt directly, then it should be stated in one or both of those documents.
