    Chase Rate Reduction mailings and UPS deliveries

    Chase holds my primary mortgage and has been sending me UPS deliveries and items in the mail about a rate reduction to 3.x %. It'd be great to refi as I am at 5.675%. However, while the information they send says they believe I qualify, on the back, it indicates if you have a bankruptcy on file, you do not. I've got 16-17 more payments to go on a 60 month plan. Even if its something I could take advantage of now as a ~2% rate reduction would be nice, I'd rather just get my plan completed first and not deal with the hassle of asking trustee/court permission and have to modify the plan now. I look at a refi after (and change to 15 year).

    I'm getting the mailings / UPS deliveries every 2-3 weeks. Are they violating anything by contacting me when they should know I am in BK and don't qualify?

    You are probably getting mailings from a computer generated list of current customers. It won't sort the ones in bk or recently out of bk. We are 40 months into our 60 month plan and get similar mailings weekly now. Orchard Bank calls and leaves messages on our machine on a regular basis. And we still get calls about lowering our cc interest rates!

    I don't believe they are in "violation" of anything. Just trying to generate new buisness. The banks are still hurting.

      It sounds like they are offering you a modification under the federal mortgage settlement. They aren't trying to collect a debt, so they aren't violating the automatic stay. If the mailings are bothering you and you don't qualify, call them and tell them you don't qualify and ask them to stop sending you the information.
