    Should I contact attorney again?

    We received a "cause to dismiss our chapter 13 case" from the trustee, due to our attorney not forwarding our 2012 taxes onto our trustee. My question is: I contacted the attorney 2 times and he promised me he would be forwarding the papers + the motion to stop the dismissal last week, should I contact him again I haven't heard squat from him on this matter, nor is anything showing up on pacer that any forms have been submitted, our final day for argueing this the 15th and I am running out of time. Does the trustee usually let you know via mail that she has cancelled this or are we just suppose to assume that its been taken care of?

    I would contact the attorney again. You have got to make sure he/she did her job that was asked of you. And from now on make sure you mail a copy of your taxes to the trustee yourself. Don't rely on your attorney to screw things up for you. That is what I do anyway just to make sure my butt is covered so to speak.

      So I contacted attorney again, and he told me that he was going to send in the paperwork today...last monday he told me it would be done before the end of the week, so he is already behind on what he told me last time i talked to him. Then he proceded to tell me that the trustee told him she did like 200 or 300 of these, well that's fine but all i am worried about is mine! Our final day is the 16th and he just acts like its nothing, its really starting to upset me alot

        I hope you have copies of all of your paperwork. Since your attorney sounds like he/she is as inept as ours was, do NOT depend on his/her word. Make sure copies of your paperwork get to your trustee, even if you have to take them in yourself. That is what we had to do. And, when our trustee found out how inept our attorney was, he contacted US directly, so that our business could be taken care of.

          Attorneys push things to the deadline all the time. Just stay on top of him until the motion is actually filed. When he tells you it's been filed, ask for a copy of the filed document or confirm on Pacer that it was actually filed.

            Hate to bring up an old thread, but were you referring to 2011 taxes? 2012 is just now ending. Or were you referring to your estimated 2012 refund?

              I was referring to to our 2011 tax copies, all has been taken care of. The trustee and the attorney confirmed copies were received, so judge cancelled court date. Thank goodness!

              PS - Oop's..i guess maybe next time i should proofread before hitting the enter key, I did say our 2012's, meant our 2011's.
