    BK Lawyer in AZ

    Good Morning,

    I don't know if I can do this, but anybody can recomend a good lawyer that would tell us a ball park payment amount on a chapter 13 without asking for us to pay the entire fee before we find out how much the monthly payment for a chapter 13 will be?

    Members can make recommendations to you, but will need to do so via PM. We are not allowed to make recommendations on the public side of the board.

    From what I have read, many Ch13 filers are able to include their attorney payments either in their plan, or outside of their plan. It is up to the individual attorney as to how he/she prefers to be paid.

      During an initial consultation, all an attorney can do is provide a reasonable figure, depending upon the information you provide. An attorney or debtor will never know what the final plan payment will be until the case is confirmed. Chapter 13 cases involving assets can get mighty complicated, and sometimes the process of discovery can yield some disheartening surprises. But not often - most debtors are aware of what they face before they file.

        While it is impossible for any attorney to guaranty what your plan payment will be in an initial consultation, I got pretty close estimates from all 3 attorneys I consulted with. Before my consultations, I sent them a spreadsheet with my financial info and they all had estimates ready when I arrived for the consultation.         Not all attorneys will take the time to come up with an estimate, but the more information you provide, the more valuable your consultation can be. The key is to find a good attorney who will work to draft a manageable plan. If you need to file BK, you need to file BK. If a competent attorney can't come up with a plan you can manage, either you are trying to keep assets you can't afford, aren't willing to make lifestyle changes necessary to live within your means or shouldn't be in a Chap 13 in the first place.
