    negotiating attorney fees AFTER your plan is completed

    Wondering if anyone has experience with this? If so, I'd love to hear your comments.

    Here's some background:

    We will complete our 13plan in about 6 months from now. We have incurred additional attorney's fees over and above what was initially planned in our plan--mostly due to unforeseen circumstances with our home (such a long story). We figure the amount of attorney's fees to be about $7k after our last plan payment. Our attorney said we could just "work it out" with her after our plan was complete as far as a payment plan.

    In addition to this $7k, we will have about $8k left on a car loan to pay and $40K in Student loans left to pay as well when we get out of our plan. The car loan has been paid through the plan but at a reduced rate and the student loans were not able to be paid, just kept taking on interest, during our plan. All total, we'll have about $55k debt to pay after our plan is over.

    Some Clean slate.

    Holy cow! 7k more for the attorney WOW...The student loans were expected I guess and lots of people have car loan debt but it sucks that you have that attorney bill to pay after the plan. Was there no way you could of modified the plan to put that extra 7k in the plan? Too late now I suppose. I hope these debts won't be a hardship and you can have some sort of a new start.

      Car loan. . . are you sure about that? Does not make sense that a secured creditor would be paid through the Plan but still be owed $$ after discharge. Please review your Order Confirming to make sure you are correct.

      Student loan. . . if a govt. loan, do some research on the "income BASED repayment plan" set up by the USDE.

      Legal fees. . . in situations like yours we usually are happy so long as the client makes a monthly attempt to pay, even if it is $50/month. It can be worked out.

        Not everybody can come out of BK with a clean slate. Where would you be today if you hadn't filed? How much debt will be discharged?

        Filed Chap 13 April 2010. Discharged May 2015.
        $143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!
