Help!! please give me input...the second attny I saw, called and gave me my payment...couldn't believe it...way more than I thought...I have had a take home pay decrease by about 500$ a month the past 2 months...the problem is they are looking at my previous 6 months, which was a lot more take home....The first attny I spoke with mentioned something about filing some sort of motion so that only my present income was counted, since it was reduced! Can't remember what she called it...I am freaking out...I thought the payment was supposed to be liveable, and I added up my expenses, and there isn't enough to pay all of them!!

911mom, others will respond but I think your first atty is referencing the Lenning decision - that is, your forward looking income is far different than your "backward" looking income; second atty may not know how to do this...can you check again with first atty?
The alternative is alas to wait another month or two to have that income recede further into the past...

In my case if I added up all the expenses that were allowed I would not qualify for a C-13 so some of those expenses will just have to not exist, like health insurance. It sucks because if I do end up needing medical care it will cost a lot more without insurance but what can you do?Filed 11/17/11 Chapter 13, 341 meeting 12/21/11. Also, remember, they pretty much want all of your extra income to pay your debtors. A chapter 13 is supposed to be livable, meaning you should have enough leftover to pay for your necessary bills, groceries, and a few miscellaneous things. It's not mean't to fund a whole lot of extras. Just an idea, I don't know what your budget looks like, but if you haven't cut it to bare bones already, you probably need to.

One thing I will say about my limited - 6mo experience about living with a 13 (spouse is in it=WE are in it) so far it's not bad...LESS than the bills beforehand...if you have a good atty and budget, it's not bad at all...SO FAR....
