    trustee won't close chapter 13 that has been discharge?

    Our chapter 13 was discharged on June 21rst. I have been waiting for the refund of account to be mail back to us. I got a hold of a lady at the trustees office and she said the trustee won't send money because of secured claim on surrendered house. They filed a secured claim and it was surrendered. Our lawyer said he would talk to her because there is no reason not to send us our money and close the case.

    They can't reopen a discharged case can they? No objections were made to the discharge either. I just don't get any of this.

    Puggy, let your lawyer take care of this. Given the info you shared in your post, your trustee doesn't appear to be justified keeping any of your Ch 13 cash on hand now that your house has already been surrendered and your case has been discharged.
