    New Medical Bills

    I filed chapter 13 on 02/14/11. I am scheduled for 341 meeting on 03/30/11. On Friday, my daughter was admitted to the hospital. My medical insurance has $3000 deductible then 15%. Should I notify attorney now or wait to get the bills?

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED

      Ya, they might be able to modify your plan. You are not supposed to live with too much financial stress in a chapter 13, believe it or not. If there was too much stress, then a chapter 7 would be in order.

      Of course, continue to stick with the budget the best you can. But, when shit happens, the attorney needs to earn their pay. Call them is right!

        We had the same thing happen, filed beginning of March 2010 and 2 weeks later, son had been admitted to hospital. We got stuck with the bill and were not allowed to amend our BK papers to include it.

            I am not sure how it should be handled. I know that setting up a payment plan with the hospital is going to make my budget so tight. I am just stressed and don't know how to handle as it was unavoidable.

              Scorpion, the OP didn't ask to discharge the debt, just how to handle new debt. (I hope you weren't being judgmental again.) The OP needs help through a stressful situation, and received good advice.

                I just saw the bills that were submitted to my insurance......Over $8000.00. So, that means I must by 3000 and 15% of the other $5000.00. So, I will owe about $4000 with just the hospital bills. In addition to the doctor's charges and other fees.

                I have my 341 meeting next week and I was going to discuss with the attorney at that time. I am currently in a plan with 0% unsecured. I know they won't let me include these charges but just unsure how I can afford payments to the hospital and the trustee payments.

                I am so frustrated. My daughter was really sick and it really hurts when you have terrible insurance.

                    You may be able to call the hospitals billing dept and explain the situation (filed for BK) and see if they wouldnt do a hardship adjustment on your bill. Sometimes they'll take off up to 40% of the bill if you fill out financial information, or even just do away with it all together if you qualify for it.

                    We had to make payments of $50 a month to our son's bill on top of our trustee payment - it took us a while to pay it off, but just last month we finally did, and they cut us a break as well, giving us 25% off the bill total because of our situation.

                    Hope your kiddo is feeling better.

                    ETA: you're at 0% to unsecureds, but from what I read you filed 13 due to car arrears - is this correct? Can you not convert to a 7 and obtain another vehicle?

                      I cannot file chapter 7 b/c I had a chapter 7 in 2005.
