    What Happens to Debts that are shown as "charged of" on Credit Report in 13 filing?

    My husband lost his job after being diagnosed with a terminal illness. So, after 5 years, returning to work, and being forced to make up the difference between his disability income, my new salary, and his old income, we are broke and looking at filing a 13. When looking at the 3 credit reports, there are 3 significant bills that are showing as "charged off". I was not aware that had occurred and that would significantly reduce what we owe. 1. Are those usually included in the BK filing? and 2. Can those creditors reopen their claims when notified of the BK filing?...or have they already gained some tax advantage to having written those bad debts off?

    "Charge off" is simply an accounting terms, the amount of money is still owed. You have to list those creditors (and the amount you owe them) on your petition. The creditors will then file a proof of claim. There is always the possibility they won't file a proof of claim and in that case they wouldn't be paid anything in your plan. Good luck to you.

      You may find that some of these "charged-off" accounts have been turned over to collection agencies which will also appear on your credit reports under a different name. They have to be listed on your filing paperwork as the debt(s) is still due and owing.
