    Got confirmed, overpayment?

I just got my confirmation notice in the mail today.

It says that I'm to pay $400/month starting September 2009. This is on a plan that was modified from what it was when I first filed Chapter 13. I paid $600/month for 5 months from 9/2009-2/2010. Am I considered to be overpaid, and am I supposed to get back the $200/month that I paid into the plan over the confirmed plan, which started back in September? This is in Boston, MA.

Thanks in advance for any experience anybody can share.

What typically happens is that your new payment has been adjusted from the former payment so that in the end your plan pays out the same % to creditors who filed claims. You don't get the extra back, but you do get a lower payment for the rest of your plan.

Of course, I'm going on just what you've shared here. The one and only way to know for sure what to expect in *your* unique case is to call your lawyer to ask how things are going to progress now that your payment is lower (and congrats on that going your way, btw!)
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
