    Had My Creditor's Meeting

    Had creditors meeting today. Yes it was less than 5 minutes, but it was a long 5 minutes. Trustee asked a question I wasn't expecting and I got flustered and didn't answer properly. I was caught off guard. Lawyer tried to explain. Did not schedule confirmation. Wants me to come back in Jan 2011. This basically means that I probably won't get confirmed until next summer.

    I feel awful and can't stop crying. My lawyer doesn't seem worried so why do I feel so awful?

    This is a once-in-a-lifetime occurrence for you, but your lawyer deals with this type of thing every day. Trust your lawyer and enjoy your automatic stay continuing a little longer than you had anticipated.

      Thanks Keepinitreal! It's hard to enjoy anything because I have back taxes to deal with and that was my sole reason for filing. If this 13 doesn't get confirmed, I'm totally screwed because the IRS is playing hardball right now with anyone who owes them any money. They are so desperate for money right now, they are going after folks who only owe a small amount, i.e. a few thousand. Now I owe more than that due to mistakes made when I had my own business, however I want to pay back.

      The issue to me seems to be the Trustee with his objections. All I want is for all this to be settled so I can continue making my monthly payment for the next 59 months (already made one) and live in peace. All of this will be moot if he tries to get more money out of me, then I can't handle the payment and it's dismissed.

      Now obviously this is worst case, but this is my life. Having the automatic stay is some relief right now, but my understanding is that if the case is dismissed (which my atty doesn't think will happen), then I'm back to square one with no options.

      I'm willing to get a second job so I have some additional income to make the payment, however people on this forum advice me not to do so. So what are my options if the case, at worst case, gets dismissed by the trustee?

          Okieblue, I sent you a private message in response to your question. I don't want to give myself away on this site. I believe my atty reads this site as well as some other people I know. Just trying to keep it so no one can guess it's me.

            Okieblue, thanks for the PM. I think most folks have a smooth creditors meeting. Mine was probably a one-off from the norm. I am sure yours will go well. This whole BK 13 process is stressful so hang in there...
